The Bharatiya Sakshya Adhiniyam, 2023 (BSA) replaced the Indian Evidence Act and introduced strict requirements for electronic records in Indian courts. Under Section 63(4)(c) of BSA 2023, any electronic record — including WhatsApp messages — requires a certificate from the person responsible for the device. Without this certificate, the Supreme Court held in Arjun Panditrao Khotkar vs Kailash Kushanrao Gorantyal (2020) that electronic evidence has no evidentiary value.
